Upon agreement by the client to hire Mad Molly Marketing, a down payment of an amount equal to one half of the total order will be secured. This deposit will cover expenses including, but not limited to, the following:
- order processing
- creation and development time
- intellectual and proprietary materials utilized in developmental stages.
The initial fee is non-refundable and does not include final usage rights, which will be released upon receipt of final payment. The client's final product will be made available and full usage rights will be granted upon final approval and payment.
Should the project scope be expanded during fulfillment of the initial order, Mad Molly Marketing may secure intermediary payments of an amount mutually agreed upon with the client, but not exceeding one half of the additional purchase amount. Intermediary fees are non-refundable and do not include final usage rights, which will be released upon receipt of final payment.
Upon the client's approval of the final product, Mad Molly Marketing will secure a final payment. Upon receipt of this final payment, all rights to the final product, full and unrestricted, will be released to the client for use in all media and in all markets, for unlimited period of time.
The client can choose to terminate his project at any time. In this event, no additional charges will be collected by Mad Molly Marketing. The client will retain no rights to any of the design work Mad Molly Marketing has completed on their behalf, and Mad Molly Marketing will retain full ownership of all work completed on the project.
Initial design concepts will be presented within 3-10 business days following the receipt of an order and down payment, depending on the type of service ordered. Mad Molly Marketing provides no guarantee of copyright to the client. The client assumes responsibility for obtaining Trademark or Copyright for any material created by Mad Molly Marketing Inc.. Mad Molly Marketing assumes no liability in the event that a client is unable to obtain Trademark or Copyright for the given material for any reason.
